Neighbor's tree fell on my property. neighbor has no insurance. will insurance go after him?

Hi, a neighbor's tree fell on my property due to extreme weather/wind. I have high deductible like ,000(!). However, insurance explained to me it is neighbor’s responsibility, therefore tree will be removed from property but not disposed just be left on neighbor’s lot. Is it like car insurance where if it is not your fault you do not have to pay deductible as the insurance company goes after the other insurance company (or the other person if he has no insurance)? In other, words is this a case where most likely I will not be required to pay deductible? THANKS
PS. i heard if his tree was dead or dying then higher chance it will be deemed as neighbor's respondibility(!) is this true? how do you tell is a tree is dead or dying? tx.

Your insurance person is not exactly correct. If your neighbor was unaware that the tree posed a potential hazard, the falling of the tree is classified as ‘an act of God’, and YOUR insurer (and you) pick up the damages. That the tree grows on your neighbor’s property does not necessarily make it his responsibility. My guess is that you will end up swallowing the first $2,000 of the damage due to your high deductible.
